Terms and conditions

Translation for your convenience. The contract language is German (see section 16). In case of any discrepancy, the German version is the legally binding one.

1. Scope

These General Terms and Conditions apply to all orders placed by consumers in the online shop of

Jonas Menter
Hahnenfußweg 10
16303 Schwedt/Oder
Germany

hereinafter referred to as the “Provider”.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

The Provider sells physical 3D-printed products.

The Provider does not sell to businesses.

2. Contracting party, conclusion of the contract

The purchase contract is concluded with:

Jonas Menter
Hahnenfußweg 10
16303 Schwedt/Oder
Germany

Phone: +49 176 55900304
Email: shop@menter.de

The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to place an order.

Customers can first place products in the shopping cart without obligation and correct their entries at any time before submitting the binding order. By clicking the button that completes the order with an obligation to pay, the customer makes a binding offer to conclude a purchase contract.

The Provider may accept this offer by an express order confirmation by email or by shipping the goods.

3. Products and scope of services

The specific scope of services is stated in the respective product description in the online shop.

Due to the manufacturing process, 3D-printed products may show minor deviations in colour, surface texture, layer pattern, dimensional tolerances or material appearance. Such minor deviations typical of production are not a defect as long as the ordinary usability is not impaired.

4. Prices, small business regulation, shipping costs

All prices stated in the online shop are final prices.

The Provider is a small business within the meaning of section 19 of the German VAT Act (UStG). No VAT is therefore charged and none is shown on invoices.

Shipping costs may be added to the stated product prices. The shipping costs are shown to the customer during the ordering process.

5. Payment

The payment methods stated during the ordering process are available to the customer:

  • PayPal
  • Credit card
  • Apple Pay
  • Google Pay
  • Pay by Bank (pay directly from your online banking)
  • Bank transfer (payment in advance)

All payments are processed by the payment provider Mollie B.V. Its terms and privacy notices may apply in addition.

If paying by bank transfer (payment in advance), the customer receives the bank details on the Mollie payment page after completing the order. The invoice amount is due within 14 days. If payment is not made in time, the Provider may cancel the order.

6. Delivery

The Provider delivers to Germany and Austria. Goods are shipped by DHL.

The delivery time is 3–5 working days unless the product description states otherwise. For payment in advance, the delivery time starts when the payment is received.

If a product is unavailable, the customer will be informed without delay. Any payments already made will be refunded in that case.

7. Custom-made products

Where products are made to the customer's specifications or are clearly tailored to personal needs, special statutory rules on the right of withdrawal apply.

The customer must carefully check any data, dimensions, templates, texts, files or other specifications before submitting them.

The Provider is not liable for errors resulting from incorrect, incomplete or unsuitable customer specifications unless the Provider is responsible for these errors.

8. Retention of title

The goods remain the property of the Provider until paid for in full.

9. Right of withdrawal for consumers

Consumers generally have a statutory right of withdrawal.

Details are set out in the Provider's separate right of withdrawal notice.

10. Return costs in the event of withdrawal

In the event of an effective withdrawal, the Provider bears the costs of returning goods that can be sent by parcel.

The customer is asked to return the goods in suitable packaging where possible to avoid transport damage. This is not a condition for effectively exercising the right of withdrawal.

11. Warranty

The statutory rights in respect of defects apply.

12. Liability

The Provider is liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, in cases of fraudulent intent, under guarantees given and under mandatory statutory provisions.

In the event of a slightly negligent breach of essential contractual obligations, the Provider is only liable for the foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely.

Otherwise, liability is excluded to the extent permitted by law.

The Provider is not liable for damage caused by improper use, modifications by the customer or failure to observe product information, unless the Provider is responsible for such damage.

13. Special notes on 3D-printed products

Unless expressly stated otherwise, 3D-printed products are not safety-relevant components, medical products, toys within the meaning of special toy safety regulations, food contact products or components intended for load-bearing, electrical, highly mechanically stressed or safety-critical applications.

Use in safety-critical areas, on vehicles, electrical installations, machinery, medical devices, children's toys, food contact surfaces or under high mechanical stress is only permitted if this is expressly stated in the product description.

The customer must check the suitability of the product for the intended purpose before use.

14. Vouchers, discount codes and promotions

Vouchers, discount codes and promotional offers are only valid during the stated period and only under the conditions stated.

Cash payment is excluded unless mandatory law provides otherwise.

The Provider may end or change promotions at any time, provided that contracts already concluded are not affected.

15. Customer account

A customer account is optional; orders can also be placed without one.

The customer must keep access data confidential and protect it from access by third parties.

The customer must inform the Provider without delay if there are indications of misuse of their customer account.

16. Contract language, storage of the contract text

The contract language is German.

The contract text is stored by the Provider. The customer receives the order details by email and can view them in the customer account if one exists. These terms can be viewed and saved on this page at any time.

17. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.

18. Consumer dispute resolution

The Provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

19. Single point of contact under the Digital Services Act

The Provider's single point of contact for users and authorities under Articles 11 and 12 of the Digital Services Act can be reached at:

Email: shop@menter.de
Phone: +49 176 55900304

Communication is possible in German and English.

20. Final provisions

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.

Statutory information obligations and mandatory consumer rights remain unaffected by these terms.
